Performance Appraisal

 Legal Analysis

Employee performance evaluation programs provide employers with a way to measure, maintain, and improve job performance. Most formal appraisal programs focus on the 6-month or yearly review. Whatever process an employer establishes, it must be uniformly and equally applied. Ignoring the company's policies and procedures could lead to lawsuits ranging from discrimination claims to alleging that an appraisal program created an employment "contract." Although employers are not required to have written records of merit or salary reviews, records of wage decisions are essential if an employer has to defend itself against charges of discrimination in pay practices.
