 Legal Analysis

Federal antidiscrimination laws -- Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Rehabilitation Act, and the Americans with Disabilities Act -- prohibit employment advertisements that express a preference on the basis of race, color, sex, national origin, religion, age, or disability. An advertisement may express a preference for one of these characteristics only if it is a bona fide occupational qualification (BFOQ) necessary for the operation of the business. Job advertisements should be carefully worded within the parameters of the law and written precisely to attract a targeted pool of candidates.
