We have some employees who have been eating their lunch at their desks while working and then ask to be punched out an hour after they leave. Would we be within our legal rights to put a stop to this practice?

A US DOL Wage/Hour investigator is about to cite an employer for requiring employees to clock out for "smoking, or other breaks" of or about 15 minutes in length. The employer is in Iowa. What FLSA regulation or other law is the employer violating?
