Can we make an individual on short term disability use their vacation time during that time? 



 



An employee was in a car accident and was out of work for 10 days. We filed a Short Term Disability claim for him. We received our STD claim check and it was only for Day 8, 9, and 10... 



I have an employee that has requested short term disability and he has not returned the medical information we require to start his payments. We have made several phone calls to him and he has not responded to any of our requests. 



If a person in NY state suffers an injury 2 weeks after becoming unemployed and becomes disabled as a result, is he eligeble to receive short term disability benefits under his previous employer's plan? 



When a employee is on short term disability for an illness which is not work-related, and then has to switch to long-term disability, are there any laws governing the employer's right to terminate that employee? 



Currently an employer with a California based corporation has an employee in New York going on maternity leave. This employee states that because CA SDI is being taken out of her check, she has to be paid disability by either California or someone. 



If an employee can not perform essential job functions and is planning to retire, can he/she use up short term disability benefits before retirement? 



Sr. Mgmt wants to have an informal STD policy which we uniformly apply (up to 60 days paid in full) but not create a formal policy and announce it as a benefit. Are there any legal concerns to such an "informal policy"? 



Is there a law that says you have to let an employee accrue vacation and sick time if they are out on short-term disability, or is it a company decision?
