The Department of Labor has a fluctuating workweek method (29 CFR 778.114) for calculating overtime pay for employees who are paid on a salary basis and whose hours vary from week to week. An employee works a 50-hour week and her weekly salary is $400. Under the fluctuating workweek method, how much overtime pay would this employee receive in addition to her salary for that week? The employee receives the $400 salary with the understanding that it constitutes his compensation, except for overtime premiums, for whatever hours are worked in the workweek.
