The Department of Labor has issued new overtime laws that change the exemption tests for overtime pay under the Fair Labor Standards Act. The FLSA regulations concerning overtime pay have been revised, effective August 23, 2004. The new salary level required for an employee to be exempt from overtime protection is $455 per week, and the various "white collar" exemptions have been revised.

The Department of Labor contends the intent of the new overtime laws is to simplify overtime rules. For example, duties tests for exempt employees are simplified, with the current "independent judgment and discretion" test being replaced by a "primary duty" test. Employers also hope that the complicated tests of the past become simplified, and the prospect of class action suits over overtime is reduced.
